Malta regulates draws through the Malta Gaming Authority, with a permit for brand promotions, simple permits for non-profits and a full licence for paid games of chance.

Three ways draws run.

Whether a draw needs a permit or a licence depends on who runs it and what entrants pay for.

Commercial communication games

Promotional draws where entrants pay only for the goods being promoted. A permit is applied for at least 10 days ahead, within monthly, annual and single prize limits, and promoters must be able to prove the game was run fairly and honestly.

Non-profit games

Tombolas and lotteries for good causes, with stakes up to €5, at least 90% of net proceeds going to the cause and a €25 permit per event.

Licensed gaming services

Paid-entry games of chance, including lotteries, are gaming services that need a B2C licence from the Malta Gaming Authority.

What operators need to know.

  1. Apply for a commercial communication game permit at least 10 days before the game starts.
  2. Keep evidence that the game was conducted in a fair and honest manner. The MGA asks for it.
  3. Games with stakes up to €1 and prizes up to €100 are exempt as de minimis games.
  4. Suppliers to licensed operators may need their own licence, so check before launch.
